THE SUPREME COURT HINTS AT A STRUGGLE

A resident of the Dickwella area in Matara had filed a fundamental rights petition to remove obstacles to the ongoing struggle at Galle Face. M. N. N. The fundamental rights petition filed by a civil engineer named Hamim in the Supreme Court was heard yesterday (02).

The request was made to issue an order to prevent such protests as the police are taking steps to disperse the peaceful protest in Galle Face.

The IGP, the Army Commander, the Secretary of Defense, the President and the Attorney General were the respondents in the petition.

State Counsel Shavindra Wickramasooriya, appearing for the Attorney General, said that the protest was being held by blocking access to the Presidential Secretariat, the Presidential Secretariat and several other key institutions. It was also stated that it would interfere with the administration of the state.

He further stated that he had not pointed out how the rights of the petitioner were being violated and that in the event of such an economic crisis in the country, no other activities other than those that would help the country recover from the crisis should be allowed to interfere with it.

More important to us than this news was the legal protection given to the protesters by the filing of this case and the dismissal of that request, as well as how security personnel, including the Sri Lanka Police Department, must be careful in dealing with the struggle.

Police as well as the security forces should investigate under Chapter XI of the Code of Criminal Procedure if any such incident occurs on the 9th of this month. According to Article 114, a person who is arrested for an offense without evidence must be released. Article 6 of the Evidence Ordinance states that even if something does not happen in one place but in different places, if they are related, they are consistent. Accordingly, the struggle waged by the people who are not dependent on the government due to the strict economic or even unlivable rule prevailing in the country and the attack on the struggle and the attacks in the future are intertwined.

Accordingly, they have requested the intervention of the courts to protect the protesters from any crime before it takes place. He called for a fundamental rights case, but said that if there was a fight between the militants and the security forces in the future, it would be to the advantage of the protesters.

This request is a very powerful testament to the advantage of the strugglers in the event of any misconduct, as all other issues are linked to the question of why the struggle exists.

Also, a person can sue again, and this is the basis for a very good case to be filed. That is, they have laid a good foundation for why the struggle exists, and the obstacles to their survival by removing it, etc., through a new case.
