It is reported that a petition filed by lawyer Mr. Nagananda Kodithuvakku against Mr. Oshala Herath, who is a social activist, was withdrawn from the Court of Appeal.
This petition was called today (05) before the Court of Appeal bench consisting of Messrs. Sobitha Rajakaruna and Dhammika Ganepola, where President’s Counsel Mr. Faiz Mustapha appeared before the court on behalf of the respondent Mr. Oshala Herath.
The petitioner, Mr. Nagananda Kodithuvakku, who objected to it, stated that it is not possible for the lawyers to appear for the respondent before the notice is issued in this case.
But the court did not allow that request and he mentioned that a lawyer can represent the respondent.
After that, the petitioner Mr. Nagananda Kodithuvakku asked the court for permission to make amendments related to this petition and it is reported that the respondent objected to it.
Accordingly, lawyer Mr. Nagananda Kodithuvakku requested the court to allow the withdrawal of this petition while reserving the right to file a new petition and the court granted the request and ruled to dismiss the petition.
