The Attorney General’s Department has expressed its willingness to do justice to Air Vice Marshal Tuiyakontha, a powerful former Air Force officer who was subjected to illegal revenge by the former Air Force Commander.
The Attorney General informed the Supreme Court yesterday (07) that he will take immediate steps to restore the privileges related to the position of retired Air Vice Marshal Sampath Thuiyakontha, who was accused of participating in several political meetings of the National People’s Force.
The bench fixed the date to call the petition on the 6th of next month.
The bench ordered the Attorney General to inform the petitioner and his lawyer in writing about the privilege of the petitioner before that date.
Senior Advocate J.M. Vijaybandara appeared for the petitioner along with Advocate Sunil Vatagala.
Accordingly, Mr. Tuiyakontha has legal provisions to file a civil case against the former Air Force Commander and recover the loss even after the order of the Hon’ble Supreme Court.
Also, there are legal provisions in the Penal Code of Ceylon to file a criminal case against the former Air Force Commander if proper legal procedures were followed from the beginning.
And there is still room for prosecution under criminal law. A criminal case against a person has been allowed for a period of up to 20 years. Beyond that, even if there is no transferability, if there is evidence, time is not an obstacle, some lawyers’ writings have indicated.
Also, a case pending in one court does not prevent the transfer of a case in another court. Accordingly, legal provisions have been made available to file a case under the criminal law and to file a case for damages. If such a case is filed, the former Air Force Commander will have to personally answer in court through his lawyers.
